On February 1, 2014, Alberta’s New Home Buyer Protection Act protects every new home built by contractors, from single family homes to condominiums. It is now legally required for all new homes to be protected under warranty which encourages builders to meet higher quality standards. Here are the top 10 things you need to know when hiring contractors to build your new home. All residential builders constructing new homes in Alberta since December 1, 2017, require a valid builder licence. Permit issuers are required to check that a residential builder has an active licence. Every home built in Alberta since February 1, 2014, requires warranty coverage.

All new homes built in Alberta require new home warranty coverage if the building permit was applied for on or after February 1, 2014. Owner builders with a valid owner builder authorization do not need a builder licence or warranty coverage for the new home identified in the authorization. An approved owner builder can choose to build with or without home warranty. Builders are responsible for making sure the home is enrolled with a warranty provider and that the warranty coverage meets legislated requirements. Owner built homes will appear in the Property Registry, but owner builders will not appear in the Builder Registry. In the case where a homeowner disagrees with a decision in the Claims Assessment Report and wishes to dispute it, it is recommended that you contact your Claims Assessor first who will review your claim with the Claims Assessment Manager.
This means all building permits for new home construction applied for after February 1, 2014, need to meet the requirements of theNew Home Buyer Protection Act. The new home warranty coverage limit and/or rebuild amount, as established in the Home Warranty Insurance Regulation, is set at a maximum of $265,000 for a single family home and $130,000 for a unit in a condominium or other multi-family complex. The act requires a minimum 5 years of coverage, with the requirement that warranty providers offer builders the option of purchasing an additional 2 years of building envelope coverage. If the report finds warrantable actionable items, NHWICC will work with the homeowner and an accredited representative to fix and resolve the issues. 11Subject to section 6, when a reconstruction occurs, the coverage in the home warranty insurance policy must cover all elements of the home, including those areas retained or not reconstructed.
The New Home Buyer Protection Act refers to a legislated dispute resolution process outlined in the Alberta Insurance Act Sections 519 and 540. These sections are not the only considerations when reviewing the legislated dispute resolution process, but they provide enough information for basic understanding. Along with informal discussion between the builder and homeowner during the process, an investigation often leads to resolution and a responsive course of action without further involvement of the Program. A conciliation investigation aims to establish the root cause of an issue and determine its warranty coverage. To identify causal factors in specialized areas, the Program may seek input from outside experts. Pre-mandatory warranty products and services apply to any Program-warrantied home whose building permit was applied for prior to February 1, 2014. NHWICC assesses the claim and sends a report with a decision to both the builder and homeowner.
The act does not apply to homes built on or relocated to First Nations reserves. The New Home Buyer Protection Act does not affect a municipality's requirement to comply with the Safety Codes Act. Accountabilities set out in the Safety Codes Act and the accreditation agreement remain the same. This includes the structure but does not include other costs such as land, contents or landscaping. The claim issues are reviewed to determine if they are warrantable under Alberta’s New Home Buyer Protection Act. In the event a homeowner believes a defect exists, the homeowner can file a claim using the File a Claim option on our Homeowner Portal or in writing to NHWICC, either electronically or by mail. If a condominium consists of a number of buildings, the applicable coverage limit in subsection applies to each building.
